Terms of Service

1. Acceptance of Terms

By accessing or using the Safar Clinical website and platform ("Services"), you agree to be bound by these Terms. If you do not agree, do not use the Services. These Terms are a legally binding agreement between you and Safar Clinical, Inc.

2. Description of Services

Safar provides a clinical-trial matching platform that helps identify potentially eligible patients, check eligibility, and route candidates to appropriate studies, with tools for sponsors, CROs, and sites. Clinical decisions remain the responsibility of qualified professionals.

3. Eligibility

You must be at least 18 and have authority to accept these Terms for yourself or your organization.

4. Accounts

Where an account is required, you agree to provide accurate information, keep your credentials confidential, and accept responsibility for activity under your account. Notify us of any unauthorized use.

5. Acceptable Use

You agree not to use the Services unlawfully, access another user's account, disrupt the Services, reverse engineer any part of them, transmit malicious code, or scrape data without authorization.

6. Intellectual Property

The Services and their content are owned by Safar Clinical and protected by applicable law. You receive a limited, non-exclusive, non-transferable license to use the Services for their intended purpose.

7. Data & Privacy

Your use is also governed by our Privacy Policy. For PHI, additional terms may apply under a Business Associate Agreement or Data Processing Agreement with Safar.

8. Compliance

You are responsible for ensuring your use complies with all applicable laws and regulations, including HIPAA, applicable FDA regulations, Good Clinical Practice, and relevant privacy laws.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. Eligibility checks and matching are tools to assist; they are not medical advice, diagnosis, or treatment. All clinical decisions remain with qualified healthcare professionals.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFAR CLINICAL SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

11. Termination

We may suspend or terminate access at any time, with or without cause, upon notice. Certain provisions survive termination.

12. Modifications & Governing Law

We may modify these Terms; material changes will be communicated. These Terms are governed by the laws of the State of Delaware.
